1. Controller and scope

• KWP (hereinafter “the Company”) owns and operates this website (hereinafter “the Website”).
• This privacy policy (the “Privacy Policy”) sets out how the Company uses and protects any information that you (the “User”) provide to the Company when using this Website.
• It applies in conjunction with the Website’s terms of use (the “Terms of Use”).
• The Company reserves the right to change this Privacy Policy at any time without prior notice.
• Only the current version of this Privacy Policy applies.

2. Data collected by the Company from the User

2.1 General While the User uses the Website, the Company collects certain data from the User and uses this data for various purposes. The type of data collected by the Company, and the Company’s use of such data, depends on the data concerned. In this respect, this Privacy Policy distinguishes between the following categories of data (all as described in this Privacy Policy; see below for further information on which data is collected and how it is used):

• Anonymous data
• Log data
• Personal data

2.2 Anonymous data The anonymous data collected by the Company includes the following (“Anonymous Data”):

• Browser type and version
• General operating system information
• The current date and time

2.3 Log data

Each time the Website is accessed (including each time a button is clicked or a request is submitted), data relating to such access by the User is stored in a log file (the “Log Data”).

Log Data includes, in particular:

• The site from which the requested file was accessed by the User
• The name of the file requested
• The date and time of the request, and the amount of data transferred
• The status of the access (e.g. file transferred, file not found, etc.)
• IP address data

2.4 Personal data The Company collects the User’s personal data, meaning information that allows the Company to identify the User. The collection of such personal data from the User is limited to data that the User has voluntarily provided to the Company by entering it into the relevant input fields on the Website, and data relating to the User’s interests and preferences resulting from recorded activity on the Website (together, “Personal Data”). This Personal Data includes, in particular:

• First name
• Last name
• Address
• Email address
• Company
• Country
• Phone number

3. Use of the collected data by the Company

3.1 Anonymous data Anonymous Data is used exclusively for the anonymised analysis of Website usage and for related statistical purposes.

3.2 Log data Log Data is used exclusively for operating the Website. The Company reserves the right to use anonymised Log Data in accordance with this Privacy Policy.

3.3 Personal data The Company uses Personal Data for the following purposes:

• To contact the User in response to, and based on, the User’s enquiry.
• To generally improve the Company’s products and services.
• Internal record-keeping (in particular order processing).

The legal basis for the processing is, for orders and enquiries, Art. 6(1)(b) GDPR (performance of a contract or pre-contractual measures), for the newsletter sign-up Art. 6(1)(a) GDPR (consent), and for the analysis of website usage Art. 6(1)(f) GDPR (legitimate interest in a functioning, user-friendly website). Personal data from orders is retained in accordance with the statutory (in particular commercial and tax law) retention periods of 7 years; all other data is retained only for as long as necessary for the respective purpose.

The Company only sends promotional emails (newsletters) about new products, special offers or other information if you have previously given your explicit consent to receive them (e.g. via the newsletter sign-up form with a consent checkbox). You may withdraw your consent at any time with future effect, for example by message to post@kaiser-wilhelm.at.

The Company uses Personal Data only in accordance with this Privacy Policy. Any use for other purposes only takes place to the extent required by law (e.g. tax or commercial law retention obligations).

4. Rights of the data subject

The User has the right to obtain information about what personal data the Company holds in relation to that User. The User may also request that such personal data be corrected or deleted, and the User may opt out at any time of the uses of personal data described in this Privacy Policy.

You also have the right to restriction of processing (Art. 18 GDPR), the right to data portability (Art. 20 GDPR), the right to object to processing of your data – in particular against direct marketing (Art. 21 GDPR) –, as well as the right to withdraw a given consent at any time with future effect (Art. 7(3) GDPR). You also have the right to lodge a complaint with a supervisory authority – in Austria with the Datenschutzbehörde, Barichgasse 40–42, 1030 Vienna (Art. 77 GDPR).

5. Analytics software

5.1 General As part of the services described in sections 6, 9 and 10, the Website may use analytics and tracking technologies to analyse the behaviour of Website visitors and to serve targeted content or advertising. For further information on the services used, the legal basis, and how to object, please see the sections mentioned as well as the privacy notices of the respective providers.

6. Content and services from other providers

6.1 General The Website may use third-party content, such as graphics from other websites. This means that the third-party providers of such content may be able to recognise the User’s IP address, since the IP address is required to transmit the associated data to the User’s browser. To the best of its knowledge, the Company endeavours to ensure that only third-party services which use Users‘ IP addresses solely for the correct display of their content are used. However, the Company cannot prevent the third-party provider from using the IP address for other purposes.

6.4 Payment processing and further services

To process payments in the Online Store, we use PayPal (PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg). If this payment method is selected, the data required for payment processing is transmitted to PayPal. To operate the Website, we also use the following service providers: our hosting/server provider (Neo IT Solutions GmbH), our email delivery service (Post SMTP) as well as – each only after your consent via our cookie settings – Google Analytics (Google Ireland Limited) for anonymised usage analysis and Pinterest (Pinterest Europe Ltd., Dublin, Ireland) for the save function (“Pin it”) and for measuring the success of our Pinterest presence.

7. Links to other websites

The Website may contain links to other websites of interest. This Privacy Policy applies to this Website, but not to (external) linked websites that are owned and/or operated by third parties. Once the User uses these links and leaves the Website, the Company has no control over that other website. Although the Company makes every effort to ensure that such websites meet the highest standards, the Company is not responsible for the protection and privacy of any information the User provides while visiting such websites. Users should exercise caution and review the privacy policy applicable to the website in question.

8. Data storage

The Company stores Personal Data on a server located in Austria.

9. Cookies

We use cookies to make our website user-friendly. Technically necessary cookies are used without separate consent; all other cookies (e.g. for statistics or external media) are only set after your explicit, active consent via our cookie consent tool (Borlabs Cookie). You can change your settings there at any time (see point 9.4).

9.1 What are cookies?
A cookie is a small piece of text sent to your browser by a website you visit. It stores information about your last visit, such as your preferred language or other settings. Cookies fall mainly into two groups:

1. Technical cookies:
These contain data required to enable the Website’s functionality and the services requested by the User, such as navigation or login features. Without these cookies, parts of the Website will not function correctly.

9.4 Cookies used

This website uses cookies: 9.4.1 Google Analytics cookies As mentioned above, the Company collects standard internet log information and details of visitor behaviour patterns using Google Analytics cookies. The Company does this to continuously improve the Website. This information does not include personal data. However, data used for analytics purposes may be linked with personal data collected from this Website or elsewhere. More information on Google Analytics cookies.

You can object to data collection by Google Analytics at any time via our cookie settings (button below).

Browsers such as Firefox can also block user tracking at the program level – please refer to your browser’s settings.

9.4.2 Pinterest cookies
With your consent via our cookie settings, our website embeds the Pinterest tag as well as the Pinterest save function (“Pin it”) (Pinterest Europe Ltd., Dublin, Ireland). These allow you to save content from our website directly to Pinterest, and provide us with anonymised information on how visitors reach our website via Pinterest. 10. Instagram content

On our “News” page, we embed posts from our Instagram channel (@kwpbeautifulthings, Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland). This content is only loaded, and data only transmitted to Instagram/Meta, if you have previously given explicit consent via our cookie consent tool (Borlabs Cookie, category “External Media”). Without your consent, you will only see a notice text at this point; no Instagram content is loaded and no connection to Instagram/Meta is established. 11. Security and confidentiality

The Company takes appropriate measures to protect the User’s personal data against loss, misuse, unauthorised access and disclosure. These measures include the use of networks secured by firewalls and passwords in line with common security standards. As an Austrian company, KWP Concept Store is subject to Austrian data protection law and is, as such, obliged to protect Users‘ data.
